Advertiser and Sponsor Terms
Effective October 29, 2026
These terms apply when a business (“Sponsor”) buys a paid placement on BreakSheet from an individual (“we”). They sit on top of the Terms of Use. If the two conflict, these terms win for the purchase. Each Sponsor agrees to these terms in writing, by email reply or checkbox, before paying.
1. Order details
Each order states: the Sponsor's name and link, what is placed (for example a link to a break of a named product, or an open-spots note for a named team), where it appears, the start and end dates, the price and how it is paid. Only what the order states is included. Changes need our written agreement.
2. Labelling
Every placement is labelled “Sponsored” or “Ad” next to the placement, and we decide the wording, size and look so it is clear and consistent. The Sponsor may not ask us to remove or hide the label.
3. Sponsor's promises
The Sponsor promises that:
- it is a real business that can lawfully run the sales it promotes, and holds any licences, age limits and platform approvals it needs
- everything it supplies is true, not misleading and has no promise or suggestion that anyone will win, profit or be guaranteed any card or value
- it owns or has permission to use every name, logo, image and word it supplies
- it follows the rules of the platform where it sells, the FTC's rules on endorsements and advertising, and all other laws
- it will honour what it advertises, ship what it sells and handle its customers' complaints and refunds
- it will not direct content at children under 13
- it will tell us promptly if a placement becomes wrong, such as a break that is cancelled or sold out
4. Independence
Paying does not buy a say over the Site's data, counts, odds, rankings or editorial content. We will not change them, hide any team or player, or give a positive statement about the Sponsor. The Sponsor's placement is not our endorsement, and we do not review the Sponsor's prices, product or customer service.
5. Our right to refuse and remove
We may refuse any placement, and may pause or remove one at any time if we think it is misleading, unlawful, unsafe, off-topic, damaging to the Site's reputation, a risk to our ad accounts, or a breach of these terms.
6. No promise of results
We do not promise any number of views, clicks, sales, customers or any other result. Any visitor statistics we share are estimates, are provided as-is and may change. Traffic can rise and fall. Ad and search platforms may change in ways we do not control.
7. Payment and refunds
The price is due as stated in the order, usually in advance. Taxes, if any, are the Sponsor's responsibility. Payments are non-refundable except that: (a) if we cancel before the start date for a reason other than the Sponsor's breach, the Sponsor gets a full refund; (b) if we remove a placement during its term for a reason other than the Sponsor's breach, the Sponsor gets a refund for the unused part of the term; and (c) if the Sponsor cancels at least 7 days before the start date, it gets a full refund. No refund is due if we remove a placement because of the Sponsor's breach, or if the Sponsor's sale ends or sells out.
8. Indemnity
The Sponsor will defend and cover us, with reasonable legal fees, against claims arising from the Sponsor's content, products, sales, promotions, customers or breach of these terms.
9. Disclaimer and limit
PLACEMENTS ARE PROVIDED “AS IS”. WE ARE NOT LIABLE FOR LOST SALES, PROFITS OR INDIRECT OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY UNDER AN ORDER IS LIMITED TO THE AMOUNT THE SPONSOR PAID US FOR THAT ORDER.
10. Relationship and general
The parties are independent. No partnership, agency, employment or exclusivity is created, and we may sell placements to the Sponsor's competitors. Neither party may transfer the order without the other's consent. The laws of the State of Arizona govern, and disputes go to the state or federal courts located in Arizona, as in the Terms of Use. These terms and the order are the whole agreement for the placement.
